North Georgia Uncontested Divorce – Minor Children
Although an uncontested divorce with minor children in Georgia is still pretty
quick and cost efficient, the court does take a closer look at the proceedings and a number of legal constraints and guidelines are
placed on the divorcing parents’ rights to make decisions as to the final form of their marital dissolution agreement. The biggest
role the court plays in the divorce is acting as a legal protector in all areas regarding the children and in order to fulfill this
function they have instituted a number of mandatory steps that the parents have to complete in order to be granted a divorce.
In all divorce proceedings involving minor children both spouses have to exchange court approved financial affidavits, complete child
support worksheets and attend a Parenting class. Please note as of October 2008 the price of Parenting Class will be either $30.00
or $50.00 depending on the county you are in. I will provide you with list of dates and locations of the class and help you
get that arranged.
As part of my services, I will prepare a draft of the marital settlement agreement and parenting plan for
you to present to your spouse based on the information that you provide to me in our initial consultation. I will also prepare the
child support worksheets for both parties and help you complete them. At no additional cost, I will make changes to the drafts
requested by your spouse and prepare a second and final draft for signature. Any additional drafts to the documents will be provided
at a low additional charge. In the alternative if both parties will agree to sign a conflict waiver, I will personally
sit down with you both and help you amicably come to a quick and fair agreement for an additional and predetermined low cost of $100.00
or less.
Once we have the final documents drafted, I will furnish your spouse with copies of the Complaint and the
other needed documents along with a document to sign stating receipt of them. Your spouse will also need to sign a waiver to
trial by jury and consent for the final decree to be heard after 31 days. Before I file the paperwork, I will need a money order
for approximately $ 82.50 made payable to the Clerk of the County where we will be filing the divorce or you can pay the fee directly
to me and I will write a check to the Clerk for the fees. After the 31 days have passed, I will ask that the case be placed
on the next available calendar. Since there are minor children involved, we will have to personally appear before the Judge
before the divorce will be awarded. Once the divorce is final, I will go with you to the clerk's office to get a certified copy
and get one to mail to your spouse. If you are a woman, we can petition the court to change your name as part of the proceedings
and you can use your certified copy to get your driver's license and other important documents changed.
